How to legalise cannabis (Colorado)

Cannabis intended for recreational purposes can now be bought and sold legally in Colorado.

This is a very good thing indeed.

Nothing very bad has happened and nothing very bad is going to happen.

We’re going to legalise cannabis here in New Zealand, too. Sooner or later.

In this series of posts (the next two instalments are to feature Washington and Uruguay) I’m going to look at the specific regulatory measures which, of course, vary across each jurisdiction. Having done so, we can then ask, which legalisation model should New Zealand adopt?

The following bullet points are sourced from Wikipedia’s article on the drug policy of Colorado.

Since the enactment of Colorado Amendment 64

  • adults aged 21 or older can
    • grow up to six cannabis plants (with no more than half being mature flowering plants), privately in a locked space
    • legally possess all cannabis from the plants they grow (as long as it stays where it was grown),
    • legally possess up to one ounce of cannabis while traveling,
    • give as a gift up to one ounce to other citizens 21 years of age or older.
  • Consumption is permitted in a manner similar to alcohol, with equivalent offenses proscribed for driving.
  • Public consumption remains illegal.
  • Amendment 64 also provides for licensing of cultivation facilities, product manufacturing facilities, testing facilities, and retail stores.

Note that Colorado’s is a mixed model. Cannabis cultivation, possession and use is effectively legalised for the individual user. Commercial cultivation and sale are heavily regulated—but hardly more so than anything else in today’s heavily regulated world.

I have no principled objection to the age limit of 21. But I think it’s unrealistically high, also I think the prohibition on public consumption is a bit austere and certainly hard to enforce. Who’s going to stop you getting high when you go hiking in one of Colorado’s beautiful National Parks?

Overall, I think Colorado’s on to a real winner. 🙂

There was plenty of paperwork to keep the bureaucrats happy.

Governor Hickenlooper signed several bills into law on May 28, 2013 implementing the recommendations of the Task Force on the Implementation of Amendment 64. On September 9, 2013, the Colorado Department of Revenue adopted final regulations for recreational marijuana establishments, implementing the Colorado Retail Marijuana Code (HB 13-1317). On September 16, 2013, the Denver City Council adopted an ordinance for retail marijuana establishments.
The first stores officially opened on January 1, 2014. The state prepared for an influx of tourists with extra police officers posted in Denver. Safety fears led to officials seeking to limit use of the drug in popular ski resorts.

Cue an interesting story about the effects of cannabis on skiing from Gary Johnson, former governor of New Mexico and the Libertarian Party’s candidate in the 2012 presidential elections, in an interview with Playboy Magazine.

PLAYBOY: Was there a specific moment, an epiphany, when you stopped drugs?

JOHNSON: I stopped pot because of a specific experience. I was going to be a professional ski racer and pursued professional racing. I skied a couple 125-day seasons in northern Idaho after college. I was racing gates every day. I never made a nickel at professional ski racing–I was lousy at it but I pursued it. One day, I set up a set of gates and punched my stopwatch and skied down the hill. I did it in 17 seconds. I went up the lift and skied down through the gates again and made 16 seconds. I went through the course again and did it in 15 seconds. The next time I got on the chairlift, a ski patrolman whipped out a joint–that was a common occurrence. We smoked pot up to the top of the lift and I went through the course a fourth time. Oh my God, I had the fastest run? It was smooth, perfect. But then I looked at my watch. I was thinking, 13 seconds! But it was 19 seconds! Whoa! It was a revelation. If I did 19 and thought I was so much faster than I really was, then this is carrying over into other areas, too. I thought, I don’t need this.

PLAYBOY: Was it the last joint?

JOHNSON: Not the last, but it broke the habit. People think they can function just as well, but they can’t. A lot of athletes smoke pot because they can’t drink and perform. Yes, you can smoke pot and perform–you can get away with it unless they are testing for drugs–but it has an impact. It has an impact on everything you do. When the Olympic snowboarder tested positive for marijuana, you have to think what he could have accomplished if he hadn’t been smoking.

PLAYBOY: Maybe the pot relaxed him so he could perform as well as he did.

JOHNSON: I don’t think so. I would argue that he could be that much better if he did no drugs.

Perhaps Johnson’s tale lends some credence to Reed’s claim that people that smoke regularly are stupid and lazy on a full time basis. But who am I to judge? 😎

The truth is I actually like Olde Lizzy… (though I am sure I could do a better job … 🙂 )
I once wrote a Queens birthday Radio show yarn on why I thought she was quite certainly one of the better monarchs of history… for example she does not impose her personal religious beliefs upon the Plebs… as was common practice a few hundred years ago.
As a Libertarian I believe New Zealand ought to become a constitutional Republic, yet this does not mean I dont like the Queen, or that I would support *any and every* Kiwi political Republican ambition as I am well aware of the possibility of a much worse form of government being established than what we have under the Commonwealth.
I am indeed very sceptical about such a move given our parliament is currently packed to the brim with Communists, racists, and Fascists who would love to assume absolute power!
Be very afraid!

Yet still this post was motivated by a very strange, silly, and tyrannical Statist Law.
A supposed crime of thought.

In Libertarian circles such thoughts…. and even actions… are a right, and a duty.

To even ‘imagine’ toppling Queen illegal… Press TV

To even “imagine” toppling the Queen or the abolition of the monarchy both remain punishable by life imprisonment in each and every country under the reign of the Queen, particularly in the UK, local media report.

This came after the UK Ministry of Justice was left embarrassed following the announcement that a list of 309 offences due to be repealed before May mistakenly included a call for the abolition of the monarchy.

The government was quick to reiterate that it is still illegal to even “imagine” so and one that imagined so could be imprisoned for life.

To imagine deposing the Crown or waging war against the Queen is still theoretically punishable by lifetime jail, although nobody has been prosecuted under the law since 1897, it has been claimed.

A routine notice from the Home Office had suggested that Section 3 of the Treason Felony Act h1848 had been repealed.

Following the announcement, campaign group Republic said it welcomed the news that a law banning public calls for the abolition of the monarchy had been scrapped.

“ … we have long called for the repeal of this law and we are pleased that parliament now formally acknowledges that republicanism is a legitimate and mainstream point of view … we have repeatedly publically and unequivocally called for the abolition of the monarchy without any legal threat,” said Republic’s spokesperson Graham Smith..

However, the Ministry of Justice said embarrassingly that it has been a mistake to announce that the law is scrapped, reiterating that republicanism still carries the title of crime punishable by life in prison.

The monarchy in Britain is not only an unaccountable, totalitarian and expensive entity, but it also is a hereditary institution within which the Queen and her family cannot be held to account at the ballot box.

Doctor, mohel, and former IDF lieutenant Yosef Glassman finds surprising links between controversial plant and ancient Judaism.

That’s right, cannabis.

This dictate, found in the Shulchan Aruch (Code of Jewish Law), piqued the curiosity of Boston geriatrician Yosef Glassman when he was reading about Sabbath rituals on a religious quest nearly two decades ago.

The future doctor decided to embark on a project to learn whether cannabis was also used for medicinal purposes in ancient Jewish times. At first, he proceeded hesitantly — the federal ban on marijuana stigmatizes even library research on the drug, he said.

But in recent years, with medical marijuana’s legalization in several states, Glassman felt more comfortable delving in. What he found was a wealth of references in the Bible and beyond. Marijuana usage, he contends, is an aspect of Jewish law and tradition that had long been buried, and one that deserves “resurfacing and exploration.”

“There is no question that the plant has a holy source, God himself, and is thus mentioned for several ritualistic purposes,” said Glassman, who is also a mohel and a former Israel Defense Force lieutenant. He lives in Newton, Mass. with his family.

Glassman also found many references to non-medicinal uses of marijuana. “It is clear that using cannabis for clothing and accessories was very common, according to the Talmud,” he said. It was used for making tallitot and tzitzit, as well as “schach” (Sukkot roof coverings).

Glassman also found that cannabis fit into the category of kitnyos on Passover, meaning that Ashkenazi Jews were prohibited from using it on the holiday. “One thus might assume that it was also consumed, perhaps as food, during the remainder of the year,” he said, noting that hemp seeds are a non-intoxicating form of protein.

Glassman first presented his findings in late October during grand rounds — a medical teaching session — at the New England Sinai Hospital in Stoughton, Mass., where he is a physician. He has since gone on to give the same lecture to lay and medical professional audiences. “The goal is to educate practitioners on the rich cultural history behind the use of cannabis as a medicine, explain its mechanism of action, and dispel myths about its safety profile,” he said at one such presentation open to the public in Brookline, Mass. in November.

He explained that he had received no commercial support for his research, that no exhibitors were present, and sorry, but there were no free samples. “Not even in those brownies in the back?” joked one audience member.

In the talk, Glassman described finding several biblical references to the herb that include Book of Numbers 17:12-13, where Aaron the High Priest, “no pun intended,” probably burned marijuana as an incense offering “during a time of turmoil.” Other passages include God’s instructions to Moses to “take for yourself herbs b’samim” — herbs of medicinal quality — and instructions in Exodus to “take spices of the finest sort, pure myrrh, five hundred shekels, fragrant cinnamon, and ‘keneh bosem,’” which literally means “sweet cane,” but possibly refers to cannabis, said Glassman. “Keneh bosem” is also mentioned in the Song of Songs 4:14, Isaiah 43:24, Jeremiah 6:20 and Ezekiel 27:19. Another pronunciation is the Aramaic “kene busma,” which, perhaps unsurprisingly, is also the name of a modern reggae musician.

Glassman’s research revealed that cannabis may have been used as an anesthetic during childbirth in ancient Israel; he described an archaeological discovery of hashish in the stomach of the 1,623-year-old remains of a 14-year-old girl in Beit Shemesh. Maimonides was also an advocate of using cannabis oil for ailments such as colds and ear problems. “There are complex laws of plant mixing and hybridizing from the Talmud, which Maimonides comments on,” said Glassman. “Cannabis specifically was taken especially seriously in terms of mixing … and could, in fact, incur the death penalty. This shows me that apparently, cannabis was treated quite seriously.”

Ancient Jews weren’t the only people to use cannabis medicinally, of course. In his lecture, Glassman noted that cannabis has been used in Chinese medicine, as one of the 50 fundamental herbs, for 4,700 years; ancient Egyptians used it in suppositories and for eye pain; and Greeks made wine steeped with cannabis and used it for inflammation and ear problems.

This is an old and valid….(though a tad simplistic I admit) Christian argument which is simply showing that the Modern regression in morality is founded upon both the acceptance of Atheist evolution and the rejection of Bible based theistic Christianity.
I say it is simplistic because some of this ‘liberalism’ has in fact been real progress because it has removed bad Laws… and as such should in fact be supported by Christians… like the End of Prohibitions on Homosexuality, etc…)
Many Christians have been taught by ignorant and bigoted preachers that such reforms are evil…. when infact Christianity proper is not about oppressing sinners and infidels. That has historically been a great evil which resulted from the merging of Church and state…. Constantine…. etc… which was a deviation from what Christianity truly is… a voluntary association… not A political lobby for Power.

This is not to say that Christians ought not to participate in the democratic process, but that they must take care to be on the side of Liberty and justice… not tyranny and oppression.
They must seek to be ‘the salt of the earth’ not by despotic Laws…. but by Example and preaching Christian values and inspiring voluntary endorsement of their beliefs.

This picture also attempts to show Christians why they must be prepared to directly confront the False religion/ pseudo science of Evolution…. because it is the foundation of so many lies and Great evils.
It was when I realised that Evolution was Bogus, that I became much more open to the truth of the Bible…. because The idea of God crating Mankind began to make much more sense.

Growing familiarity with marijuana has been accompanied by growing support for legalization because people discovered through personal experience that the government was lying to them about the drug’s hazards. But it is easier to demonize less popular drugs such as crack cocaine and methamphetamine, which in the public mind are still linked, as marijuana once was, with addiction, madness, and violence. Any attempt to question the use of force in dealing with these drugs therefore must begin by separating reality from horror stories.

That is where Carl Hart comes in. Hart, a neuropsychopharmacologist at Columbia who grew up in one of Miami’s rougher neighborhoods, has done bold, path-breaking research that challenges widely accepted beliefs about crack and meth. In his inspiring and fascinating new memoir High Price, he describes both how he overcame his early disadvantages to secure a tenured position at an Ivy League university and how he came to question everything he thought he knew about drugs as he learned to think critically about the issue.

Before he became a scientist, Hart believed that people who use crack generally get hooked on it and thereby lose control of their behavior. But when he looked at the data on patterns of drug use as an academic, he could plainly see that only a small minority of people who try crack become heavy users. “Even at the peak [of] widespread use,” he writes, “only 10–20 percent of crack cocaine users became addicted.” According to the National Survey on Drug Use and Health, just 3 percent of Americans who have tried this reputedly irresistible and inescapable drug have smoked it in the last month.

Contrary to what anti-drug ads claim, Hart observes, addiction “is not an equal-opportunity disorder.” He notes that even rats, whose voracious consumption of cocaine in certain contrived conditions supposedly shows how powerfully addictive that drug is, tend to use it in moderation when they have other options, such as food, sex, or an interesting environment to explore.

Crack “gained the popularity that it did in the hood…because there weren’t that many other affordable sources of pleasure and purpose,” Hart writes. “And that was why, despite years of media-hyped predictions that crack’s expansion across classes was imminent, it never ‘ravaged’ the suburbs.”

Furthermore, Hart’s own research with heavy crack smokers found that, in contrast with the stereotypical addict who cannot help but immediately consume whatever crack is available, they frequently rejected the drug in favor of small cash payments or vouchers. He got similar results with meth snorters, even though he deliberately recruited frequent consumers who had no interest in stopping. These findings underline a crucial truth that Hart emphasizes: “The effects of drugs on human behavior and physiology are determined by a complex interaction between the individual drug user and her or his environment.”

Hart debunks various other misconceptions about crack and meth. He notes that the vast majority of violence attributed to crack grew out of black-market disputes, as opposed to the drug’s pharmacological effects. His studies found that cocaine and methamphetamine do increase heart rate and blood pressure, but the effect of typical doses is not dangerous in otherwise healthy people. He argues that research linking meth to brain damage confuses correlation with causation and fails to show that meth users’ cognitive capabilities are outside the normal range. And in case you were wondering, “There is no empirical evidence to support the claim that methamphetamine causes one to become physically unattractive.”

We need to expose the war on Drugs for the Brutal tyranny and injustice that it is and empty our prisons of innocent people, and remove such revenues streams from the vicious Drug Cartels and gangs… exactly as ending Alcohol prohibition achieved.
