Tracinski’s ratchet

The last time I stood as a candidate for the Libertarianz Party was in the 2008 general election. We gained 0.05% of the party vote. We needed to gain 5% of the party vote to reach the MMP threshold and get 6 libertarian MPs in Parliament.

We needed to be 100 times more popular with voters. But then what? What if we gained 5% of the vote and ended up with 6 libertarian MPs in Parliament? What would we actually do once we got in there?

To be honest, I didn’t give the question a great deal of thought at the time. But Peter Cresswell did. He advocated a principled rule of thumb which I’m going to call Tracinski’s ratchet.

Writing in the Intellectual Activist (July 1995), Robert Tracinski says

In judging a measure, one cannot hold it responsible for all aspects of a mixed economy – only for those aspects it changes. These changes can be evaluated by a straightforward application of the principle of individual rights: Does the reform remove some aspect of government control or does it add more control? … It is not a compromise to advocate reduced government control in one sphere even if controls in other spheres are left standing. It is a compromise, on the other hand, if one seeks to purchase increased freedom in one area at the price of increased control in another.

PC called this rule of thumb a ratchet for freedom. Or, more freedom with no new coercion. Or (as I remember it, anyway), new white, no new black.

It looks almost like a corollary of the Libz slogan More Freedom Less Government, doesn’t it?

Here’s what PC says in his post Transitions to freedom: Shall we kill them in their beds?

Start with what you find, and design the means to work step by step towards your goal, without ever purchasing increased freedom at the expensed of increased coercion. This is what is meant by the phrase ‘ratchet for freedom.’

A principled opposition — call them ‘Party X’ — would promote such policies. … The principle with each policy must be clear: More freedom with no new coercion.

PC then gives a couple of examples of policies that pass the test (including my own Transitional Drug Policy) but also some that fail. Here are a couple of the proposals that fail.

Flat Tax: Here’s another example of this same error. A “low flat tax” would reduce taxes for some, true, but this reduction would be purchased at the expense of increased sacrifice by those whose present tax rates are below the chosen flat rate. Far preferable is the Libertarianz transitional proposal (and Green policy) to offer a threshold below which no tax at all is paid, along with the slow and gradual increase in the level of this threshold.

School Vouchers: The idea of school vouchers is popular (not least with the purveyors of twilight golf and the owners of Wananga o Aoteaora). Vouchers do purchase wider choice, it’s true, but only at the expense of either bringing private schools even more under the Ministry’s boot (as a once relatively free early childhood sector now understands), or of throwing the taxpayer’s money away on bullshit. Best just to give the schools back and be done with it.

Two policies very popular with the libertarianish ACT Party. You can now see why Lindsay Perigo dubbed them the Association of Compulsion Touters. Not pure enough! Pragmatism over principles and how soon until we arrive at the bottom of the slippery slope?

The problem with Tracinski’s ratchet is that it doesn’t work. If Tracinski’s ratchet doesn’t allow us to move from an oppressive, progressive tax regime to a low, flat tax then what use is it, really? If Tracinski’s ratchet doesn’t allow us to move away from one-size-fits-all state factory farms of the mind to a school voucher system any time soon, then patience is a virtue.

Here’s a thought experiment to illustrate the general nature of the problem.

Suppose we were lucky enough that we already lived in a prosperous country with a low, flat tax rate. (The opposite of the actual case, but just suppose.) And suppose that the Libz got elected to Parliament and found themselves in opposition to a fiscally irresponsible socialist “tax and spend” government. Suppose that the government tables legislation—let’s indulge in some newspeak and call it the Fair Tax Act—that would replace the low, flat tax rate with an oppressive, progressive tax regime but with the sweetener of a tax-free income threshold of, say, $25,000. How would the Libz vote?

The new tax system means some new freedom. Low income earners will find themselves paying less tax. More of their own money staying in their own pockets. But the new tax system also means lots of new coercion. Middle to top income earners will find themselves paying a lot more tax. So, some new freedom but also some new coercion. The measure fails to pass the Tracinski’s ratchet test. Libz vote against it.

But the government passes the measure anyway. And, over the next Parliamentary term, the economy suffers. (Predictably enough.) All the economic indicators are bad. So bad that the main opposition party campaigns on the platform of repealing the Fair Tax Act. And wins the election! The Libz also sneak back in, too.

Now suppose that the new government tables legislation—let’s call it the Fair Tax Repeal Act—that would simply revert to the previous low, flat tax regime. Gone is the oppressive, progressive tax regime but so, too, is the tax-free income threshold. How would the Libz vote?

Reverting to the previous tax system means lots of new freedom. Middle to top income earners will find themselves paying less tax. More of their own money staying in their own pockets. But reverting to the previous tax system also means some new coercion. Low income earners will find themselves paying a lot more tax than they were before. So, some new freedom but also some new coercion. The repeal measure fails to pass the Tracinski’s ratchet test. Libz vote against it.

So there’s the problem right there. Nearly always, Tracinski’s ratchet means that bad legislation cannot be straightforwardly repealed. Unless it is really, really bad legislation. Bad through and through. Didn’t give anyone any new freedoms at the time, so repealing it isn’t going to take any new freedoms away, just restore old ones.

(PC does offer a partial defence of Tracinski’s ratchet, but I’ll get to discussing that in a future blog post. I’m not done with Tracinski’s ratchet yet! Spoiler. A partial defence isn’t good enough, and the whole concept of Tracinski’s ratchet is deeply flawed.)

The Psychoactive Substances Act is really, really bad legislation. Bad through and through. Pure evil, in fact. It meant plenty of new coercion (thousands of previously legal recreational drugs banned) and no new freedom. Some manufacturers and retailers were allowed to continue to sell products they were already legally selling, but only if they applied for and were granted interim product licences at $10k a pop. No new freedom, just more new coercion. And now the Act has been amended. All interim product licences have been revoked. Yet more new coercion.

So Tracinski’s ratchet would, at least, allow Libz MPs to vote to repeal the Psychoactive Substances Act. But only because it is thoroughly bad.

The Misuse of Drugs Act is thoroughly bad legislation, too.

Repeal the PSA! Repeal the MODA! End the War on Drugs™!

Oh, wait. That’s right. I almost forgot that over the past year I’ve changed tack and sailed off course and become an apologist for Socialist Statism. We can’t just repeal our draconian drug laws, damn it. Because that would be way too much freedom all at once. People might overdose and put pressure on the public health system and we can’t have that. Got to keep costs down and taxes up.

It is my personal view that we should legalise all drugs. But in an orderly, paternalistic, supervised fashion. Starting with cannabis. Let’s see how cannabis legalisation goes, and take it from there. If it were up to me, I’d rank all drugs in order of safety, and legalise them in that order, over an extended period of time. That’s my policy. Obviously, most of the recently banned synthetic cannabinoids would be some way down the list …

We all witnessed last election ‘Righty Hone Banks’ knife his dear leader, Don Brash for publicly expressing his views that Cannabis should be de-criminalised.
We all know this treacherous disloyalty cost the Act party and Don Heavily … though Banksy still got his Baubles of power.
Consequently Acts support under ‘National Banks’ sunk to absolute Zero.
(Did Banksy and his Fascist Faction really think Freedom lovers would support such a Carnie side show?)

From all the rhetoric I have herd from ‘lefty’ Hone Harawera… he is as anti- Decriminalisation as his Pakeha counterpart to his Right.
Things could get ugly for Laila… just as they did for Don.
This could be an interesting week in politics.
As a Libertarian, I am always hoping that more, and more parties adopt policies in favour of ending prohibition on Cannabis because to achieve such reforms through parliament and maintain them requires a broad multi-party consensus.

John Banks has achieved nothing but being the flunky for John Key.

This is the ‘Human factor’ at work in ‘Science’, and is why the vast % of ‘Research’ ends up ‘proving’ the hypothesis of the ‘researcher’.
Simply put…. they impose their theory upon the data… cherry picking whatever they can make fit their arguments, and ignoring/ passing over/ covering up any ‘anomalies’ which go against their ambitions.

The Video below at first appearance looks very dubious, yet the Guest speaker presents some very interesting evidence to support the idea that dinosaurs were still around until a few thousand years ago, rather than millions upon millions.

What is also telling is how the scientific community reacts to such evidence which threatens to overthrow all their cherished beliefs.
The truth is that none of the pet theorys of atheism actually have a solid scientific foundation…. materialism, evolution, abiogenesis, etc.
all of them are purely based upon the assumption of atheism.
Ie none of these ideas are provable via observation and experiment.
Thus the claims made by atheists that science supports their theories is a gigantic lie… none the less they are prepared to not only cling to it, but to actually deny *all evidence* which proves them to be wrong.

I have been thinking about this sort of thing lately, and how it appears to not only futile to discuss points of difference with people whom have no interest in dialogue for the sake of finding the truth via reason, but can in fact make things worse because their irrationality sticks like mud to everything in the vicinity.
It is obvious that we should not argue with fools… yet it is less easy to walk away from defending your values from someone whom may not be a fool… yet is stubbornly refusing to see reason.

As a person whom holds ‘Unorthodox’ Religious and Political views which are at variance with the Status quo, I live in a world in which my rationale bounces off walls to a far greater degree than it is received with thanks giving.

So often I make valid points in defence of my position, and yet it is as if I have fired a blank… my antagonist simply carries on with their Tirade without even flinching.

I am beginning to realise that once I have stated my position, that I must look for signs that any further discussion is truly rational…. to be on guard that I am not wasting my time talking to a brick wall.

Sometimes Its more important to ‘let it go’…. if you value their friendship.
And lets be honest…. ‘Let he who is without sin caste the first stone’… we all can be stubborn fools at times, and it is nice when other people cut us some slack.

I believe one way Satan works to destroy Christians and prevent them being victorious advocates of God’s truth is by pricking our pride, and having us waste time and energy on issues which are less essential than the Gospel, and Biblical truth.

Every time Christians argue over trivial things…. Satan Laughs and spreads his wings.

Over the last few months I have written several blogposts about a fledgling voluntary charity which has begun operating in Hamilton City, Waikato, New Zealand, attempting to embody the Christian principle of Loving our neighbor as ourselves.
Hamilton Homeless was started by a small group of Mormons concerned about the growing number of Homeless people living in the Central City.
They saw their plight and felt a Religious Humanitarian obligation to do something about this unfolding tragedy, and rallied Hamiltonians to start providing free meals, clothing, and Love to the many people in desperate need.
And caring Hamiltonians of all shades of Religious and cultural backgrounds put aside their doctrinal differences, and in the spirit of Good will and co-operation have been working together in this Righteous endeavour.

Despite these obviously noble and selfless ambitions aimed at helping the most needy sector of our society, and the fact that all this Charity work is being done voluntarily and without any politically imposed burden on Hamilton residents and ratepayers, ‘Hamilton homeless’ has nonetheless become the target of what can only be described as an orchestrated and on-going campaign of oppression at the hands of the City Council, in whose warped minds… it is more important to foster a commercially and Politically aesthetic façade of Hamilton’s CBD a place of glamour and affluence, than any concern about the *Real World* Poverty which is growing there… a reality they intend to shove into a dark corner…. Away from the public view.
‘Out of sight…. out of mind’.

There can be no doubt that the Council is behaving in a malicious and oppressive manor…. abusing it’s political power to violate the rights of the citizens of Hamilton to exercise their Religious convictions in a peaceful manor, …. having threatened the Land lord of a property ‘Hamilton Homeless’ have rented for the purposes of avoiding City Council threats of arrest for feeding the Poor on public spaces… without a permit.

Council staff have put pressure on the Landlord demanding he insists Hamilton homeless immeadiately stops feeding the poor from their rental property.

It appears that even though Hamilton homeless have acquired their own private property… quite a distance from any commercial interests whom might complain about poor people ‘loitering’ in front of their businesses, that the Council is determined to shut this Charity down.

I personally believe the Council is in serious violation of Private property rights, and intend to investigate whether or not the laws of our Nation protect our private property rights, and religious liberty, or in fact sanction such vile abuses of political power!
On top of this wicked agenda, It is of course truly heartbreaking to the compassionate members of Hamilton Homeless that the Poorest members of our community… the people whom they seek to serve… are in danger of loosing this loving support.

This really is a question of our rights to peacefully practice our religion, and follow our own conscience.

Private property rights are not merely a Legal protection against theft…. Not merely a foundation for establishing and exchanging ownership and legitimizing trade, it is fundamentally a principle which establishes *a space* …. *a place*… where citizens can worship their God/God’s, and peacefully practice their beliefs.

This function of private property is a fundamental corollary of our inalienable rights as individuals to Religious liberty, and is why we live in a society which is to great extent a testimony to Religious tolerance and peaceful co-existence.
We as individuals have the inalienable Right to form voluntary associations, and to function as a group, from private property… and it is a measure of the Justice of any society to the degree that such Freedom is protected from molestation and any potential violence of intolerant bigotry at the hands of other citizens, or from political oppression from the powers that be.

And the glory of these principles of Rights….Freedom, Equality, and Private property is why here in New Zealand that within the space of a few kilometres you can have a Catholic church, an Islamic Mosque, and a Mormon Temple… with virtually zero religious conflict!
This is truly a wonderful testament to the virtues of a society which has respect for these principles, and All New Zealanders should be Eternally Vigilant… watching politicians and Public servants, that they don’t start to undermine our Rights and Liberties… and to be always ready to Rally in defence of *Any voluntary association* whom has become the victim of political oppression.

Real Christians, and Patriots ought to rally in defence of Muslims, or Hindus… should it become apparent that their Religious liberty is being violated.
All our rights are equal.
When government threatens the freedom of anyone, they are in reality a danger to every ones freedom.
It is only the foolish and ignorant that don’t appreciate this… and the Nasty Bigots whom enjoy watching people whom hold different beliefs being suppressed.

Socialist Governments and Councils love to try and divide our society into separate groups and to systematically oppress these sub-sections, and it is appallingly far too often that New Zealanders go along with such corrupt political agendas instead of unifying for the sake of the principles of Freedom, equality, and Real justice… realizing what really is at stake… ie either maintaining a system of justice and freedom, or allowing the government and city councils to start telling us what peaceful religious beliefs we are allowed practice on our own property!

And Private property rights, in regards to religious liberty also exist on rented properties as long as all activities are kept within any caveats that may have been conditional upon agreement to lease.

Hamilton Homeless was doing exactly that.
It is not a commercial enterprise.
It is not a Community house.
It was not even cooking food, and therefore is not subject to Health department regulations which apply to such things as Restaurants, Cafes, etc.
It is a privately rented house in which invited people in need to come and enjoy food which was being cooked in other private homes… the very same way that we all cook our own Kai… and all this was done peacefully, quietly, and in love… the same way that is very common in Communities of strong communal bond… for example in many Christian, Indian and Maori homes the front door is always open, People come and go at leisure, They sing songs and enjoy fellowship… nothing at all strange or evil about it.
This may not be everyone’s ‘cup of tea’… there are of course millions of Kiwis whom shun such openly communal living… enjoying their own privacy and insulation, yet I would hope that such people are still tolerant of their neighbors whom have much larger community involvement.

It is truly tragic when small minded prudes allow their own closeted ways to become motivation for making complaints against their neighbors more open enjoyment of their properties… and lobby the Government and Councils to generate and impose heavy restrictions which violate Freedom and equality.

That is the road backwards towards societies of Intolerance and conflict.

Thus I fervently argue that Hamilton homeless has become the target of political oppression and abuse of power.
I hope to be invited to attend any meeting of the Hamilton homeless executive to discuss how to move forward and fight this council injustice.

I hope to inquire what legal grounds, if any the Council staff had in approaching Hamilton homeless’s Land Lord as I believe they have seriously overstepped their duties as servants of Hamilton ratepayers and residents.
I hope to inquire what legal right, (if any) the Land lord has to insist Hamilton homeless cease to feed the poor from that address, or whether in fact he is in breach of their tenancy rights.
Did their Landlord know what purposes Hamilton homeless intended to use the property for when he rented them the house?
I will be asking these sorts of questions.
I do believe everyone should respect their landlords reasonable requests, yet It is a very poor show if the Landlord is simply bucking under the duress of a Bully Council which is out of control…. Esp to detriment of the Poor, Cold, and Hungry!

I will report back as things run their course…. For good or ill.

It may amaze some readers to realize just how uncaring and Nasty Hamilton City council is behaving on this matter, yet a quick Google search will reveal to any inquirer just how common this sort oppression is meted out by Heartless Councils around the globe upon Charities whom care for the Needy.

Eg>>>> Here <<<< The difference being how the various communities respond… to the knowledge of how their elected officials and paid City staff treat the most vulnerable and exposed members of our community! How will you Hamiltonians and Kiwi’s respond to this local crisis? Will you rally in defence of voluntary charity and your poor neighbours? poor

I am reminded of a homeless Beggar whom not so long ago was found dead in the Waikato River after being thrown out of his hovel by a Hamilton City Ticket Warden whom had no business doing so!
He was not on council property, but had found a corner somewhere along the Riverside on Private land where he had lived in squalor for some time, yet had not caused any one any real harm.
The Council worker went out of his way to take away the smallest comfort this poor soul had in this world… and he died.
I think this story is a exemplar of just how Cold hearted, and indifferent to the plight of others some Public servants can be.
Vicious and tyrannical.
Poverty is happening not only in Africa… but is growing here in God’s own!

This sorry tale also shows the sort of Dire straights many people are finding themselves, and the urgency with which the down and out need the care and compassion of people like Hamilton homeless.

This is a matter of Religious Conscience.

Will You readers spread the word and rally in defence of this Noble charity?

As a Libertarian I will be doing my best to guide ‘Hamilton Homeless’ to remain fully private and voluntary so as to maintain it’s moral stature as true charity in the Christian sense of the word… rather than becoming another burden upon the backs of struggling ratepayers and renters.
As far as I am concerned…. we just want The Council to ‘Bugger off’ and leave us Hamiltonians to take care of business ourselves.
